Please read through the terms and conditions and the ordering procedure below carefully before entering any contract of sale with performancebrakes.co.uk part of the Cooksferry Group.

Your statutory consumer rights within the UK are not affected by these terms and conditions.

Ordering Procedure and Ways of Paying

When ordering and paying for goods from performancebrakes.co.uk you will find the procedure simple and secure. All prices are shown in pounds sterling and include VAT @ 17.5%. Packaging and delivery of all orders are delivered free to all mainland UK addresses and orders are accepted by various methods such as: on-line, by telephone, fax and mail.

Buying On-Line/Making a Purchase

In order to ensure your on-line purchasing security, we use an Internet Payment Company called PayPal, to deal with all payments. Their secure site ensures that only you and PayPal will have details of how you have paid. The whole process is swift and seamless, and PayPal assures security for you, the customer and us.

By Phone

Once you have decided on the items you wish to purchase, call us at our shop premises and phone your order through on telephone number +44 0845 652 0798. Opening hours are Monday to Friday 9.00a.m. - 6.00p.m.

By Fax/Mail

Orders can be accepted via fax by using fax number +44 020 8805 5351, or post your order and details to us at our address. You will be required to provide the following details:

  1. Full Name
  2. Delivery Address
  3. Telephone Number
  4. Credit Card Number
  5. Expiry Date
  6. Full Name as stated on the card
  7. Card Issuer (Visa or other)
    (All major credit and debit cards are accepted)
  8. Product(s) description and part code number

Alternatively, you can send payment by cheque. We use Transax Cheque Service, which offers a same day cheque authorisation service. Cheques should be made payable to: Performancebrakes.

Security

In order to ensure your on-line purchasing security, we use one of the world's largest Internet Payment Companies called PayPal, to deal with all payments. Their secure site ensures that only you and PayPal will have details of how you have paid. Their process is swift and seamless, and PayPal assures security for you, the customer and us.

When you use PayPal's secure payment facility, the personal information that you enter is sent to their server in encrypted form. This is a highly secure way of transmitting information via the Internet. The information that is encrypted includes your credit card details, name and address, and any other personal information that you have submitted. Your credit card details are NEVER stored on our server, therefore cannot be viewed by any member of our staff or any other person.

Performancebrakes.co.uk reserves the right to decline or refuse any orders that we feel may represent a financial or fraudulent risk. We have the right to report to the police and credit card authorities any customers who deliberately place fraudulent orders.

Pricing/Payment

All prices are shown in pounds sterling and are inclusive of VAT at a rate of 17.5%. Your credit card will only be debited upon despatch of an order.

Delivery

We deliver to all addresses in the UK mainland free of charge, for items purchased at £50.00 and over. For the Scottish Highlands and Islands, Northern Ireland, Republic of Ireland, Southern Ireland, Channel Islands, Jersey and EEC countries; please see delivery charges below.

For delivery of items to Non-EEC countries in Europe and other overseas countries, you will need to e-mail info@performancebrakes.co.uk with the items you wish to purchase and we will provide you with the most cost-effective and efficient shipping options.

Orders can be delivered to your home or workplace and will require a signature. If no-one is available to sign for the goods, the courier will leave a card with telephone number details for you to arrange another delivery. Within the shopping cart there is a facility to add special delivery instructions. For example, 'If I am out, please leave with a neighbour'.

Deliveries are made on weekdays (Monday - Friday 8.30a.m. to 5.30p.m.). Please see details below:

Please Note: At present, we cannot deliver to a BFPO address.

Returns Policy

At performancebrakes.co.uk we offer 100% guarantee that if you are in any way dissatisfied with the goods you have received, we will exchange them or give you a full refund. The goods returned must be in its original packaging, intact and returned within 14 days. We cannot offer this refund guarantee on goods that have been used, unless the product is faulty.

Where a refund has been requested, your credit card will be credited no later than 2 working days following receipt of the returned goods. If a replacement is required, this will be despatched within 24 hours, if the item is in stock.

Part Delivery/Faulty or Damaged Goods

In the event of goods being received damaged during transit, we should be notified within 7 working days after receipt of the goods. This may be via e-mail, fax, post or by telephone. Where the goods are found to be faulty or damaged, a replacement or full refund will be offered. In all cases, we will not make a refund until we have received the goods and made our own assessment of it. This will happen within 24 hours of receipt of the goods and we will contact you to confirm whether the replacement or refund has been granted.

EU Distance Selling Laws

Under the "EU Distance Selling" laws, you the consumer have a "Right to Cancel" the order, within 7 working days. Should you wish to do this, you will be responsible for the item/s to be returned to us in their original UNOPENED packaging. Once the items have been returned to us they will be inspected for any damage. Providing that there is no damage, you will be credited the amount paid less delivery costs, in the same way that we received the funds from you. This process will happen within 24hrs of us receiving your returned goods.

If you have used the goods in anyway, you have deemed to accept the goods, and the goods cannot be returned under " Right to Cancel" guidelines above.

If the packaging has been opened, and you wish to return the goods, under the "Right to Cancel", then the goods can still be returned, as outlined above, but will be subject to a 20% restocking fee. Once goods have been opened it is illegal to sell them to another consumer again, unless they have been re-boxed, in new packaging. Special order goods shall not be returnable under any circumstances.

Stock Availability/Back Orders

We aim to hold all items in stock at all times. However, sometimes a product can be more popular than anticipated or there may be occasional delivery delays from manufacturers. Under these circumstances, we will inform you immediately when the item will become available. If the original delivery date cannot be met due to an item being out of stock and you would rather not wait, you will be offered the option to cancel the order and receive a full refund.

Specification/Guarantee

Every effort has been made to ensure that all the specifications are correct. However, technical details such as: data, dimension weights, etc serve as a guide only and no guarantee is given or implied that goods supplied will conform in absolute detail to the description and illustrations published. You will be given the option to accept or decline any substitute offered if it does not match the original order specifications.

Privacy/Confidentiality

The only information we have regarding you is what you have told us. Your personal information is only available to Cooksferry and the Internet Payment Company, PayPal and kept in a secure environment and only used to provide a good standard of service. The information you will be required to provide when placing an order is as follows:

  1. Full Name and Address (must match the address to which the card is registered)
  2. Telephone Number
  3. Delivery Address (if different)
  4. Credit or Debit Card Details

In accordance with the Data Protection Act 1988, we may, from time to time, use this data to inform you of special promotions/offers, service changes and other information useful to you. If you would prefer us not to use your details for this purpose, let us know by sending an e-mail to: customerservice@performancebrakes.co.uk and we will ensure to delete your details from our records.

On occasions, your telephone number may be passed on to the courier company solely for the purpose of contacting you should there be any problems with delivery of the products.

Under no circumstances will your details be disclosed, passed on, rented or sold to third parties. Cookies are used on our website but solely to keep track of the contents of your shopping cart once you have selected an item.

Unsolicited E-Mail

We do not send any random or un-targeted unsolicited e-mails.

Handling Complaints

We aim to deal with any complaints you may have in a fair, confidential and effective manner. All complaints will be acknowledged within 5 working days and provide a likely timescale for resolving the complaint. At all times during the complaint you will be kept informed of any progress.
